THEY'RE WORKING ON A NUMBER OF THINGS, MOSTLY WITH NJDEP. BUT THE ONE INITIATIVE THAT WE ARE ENGAGING WITH THE MONTGOMERY BUSINESS ASSOCIATION IS THIS SOMETHING CALLED SAVE THE STUFF, WHICH IS BASICALLY WHERE INSTEAD OF GETTING THE PLASTIC, WHERE WHEN YOU GO TO A RESTAURANT AND YOU TAKE OUT FOOD, YOU DON'T GET IT, BUT UNLESS YOU ASK FOR IT. SO IT'S FIRMLY ROOTED IN BEHAVIORAL ECONOMICS WHERE IF YOU KNOW SOMETHING IS NOT GOOD FOR THE ENVIRONMENT, THERE'S A LOT OF EXTRA PLASTIC THAT'S JUST NOT USED AND THROWN AWAY, THEN JUST DON'T MAKE IT AVAILABLE UNLESS SOMEONE ASKS FOR IT AND THEN THEY CAN GET IT. SO THE EDC WE MET, WE ACTUALLY DID MEET WITH SOMEBODY FROM THE ENVIRONMENTAL COMMISSION WHO DID DISCUSS THIS WITH US, BECAUSE I GUESS WE REPRESENT MORE OF THE BUSINESS SIDE OF EVERYTHING. AND, YOU KNOW, WE'RE WE'RE LOOKING INTO IT. IT'S THE MORE THE RESTAURANTS AND THE FAST FOOD THAT IS NEEDS TO JUST NOT PUT IT IN THE BAG, BUT JUST OFFER HAVE IT AS AN OFFER FOR SOMEBODY TO TAKE IT. I KNOW THERE'S MAYBE A LITTLE BIT MORE OF A FRUSTRATION FOR TO SAY, HEY, DID IT. SO I APPRECIATE EVERYBODY FOR COMING OUT. WE DIDN'T HAVE AG MEETING THIS WEEK, THIS MONTH, AND THE MUNICIPAL ALLIANCE HAS STARTED TO DO WHAT THEY DO BEST AND SUPPORT OUR CHILDREN AND EVERYTHING ELSE. THE DEPARTMENT OF HEALTH WOULD LIKE TO REMIND EVERYONE IN OUR COMMUNITY TO GET THEIR FLU VACCINE. THE CLINIC SCHEDULE IS POSTED ON THE WEBSITE. WE VACCINATED OVER 100 PEOPLE ALREADY, AND IF THERE ARE ANY SENIORS OR REQUESTS FOR VACCINATIONS FOR HOMEBOUND RESIDENTS, PLEASE REACH OUT TO THE HEALTH DEPARTMENT. ON SATURDAY, OCTOBER 18TH, THERE WILL BE A WALK OF HOPE AT THE CARRIER CLINIC FROM 10 A.M. TO NOON, AND ON SATURDAY, OCTOBER 25TH, THERE WILL BE AN EVENT CALLED HALLOWEEN. THIS IS A PET FOCUSED HALLOWEEN EVENT WHERE WE WILL PROVIDE BITE PREVENTION AND PET LICENSING INFORMATION. THAT SOUNDS LIKE FUN. AND OF COURSE, FOR, YOU KNOW, FOR HUMAN PEOPLE, WE WILL HAVE TRUNK OR TREAT ON SATURDAY, OCTOBER 25TH FROM 2 TO 4. FINALLY, THE AGE FRIENDLY SURVEY IS OUT. THE OPEN SPACE COMMITTEE IS WORKING WITH THE ENGINEERING DEPARTMENT TO CAPTURE IMAGES AND VIDEOS OF OPEN SPACES AND PATHWAYS SO THAT WE CAN PUBLICIZE THE PATHWAYS AND THE OPEN SPACES THAT WE HAVE ON SOCIAL MEDIA. WE'RE ALSO WORKING ON DIRECTIONAL AND WAYFINDING SIGNS THAT WERE INSTALLED ON CHERRY BROOK PRESERVE THAT WERE FUNDED BY A GRANT FROM MONTGOMERY FRIENDS OF OPEN SPACE. AND THERE ALSO WAS A REQUEST FOR A WINDMILL ON DEAD TREE RUN ROAD. AND, YOU KNOW, THE VARIOUS ACQUISITION UPDATES.

AND THEN FINALLY, I'D LIKE TO GIVE AN UPDATE ON SOMETHING THAT HAS, YOU KNOW, BEEN OUT THERE A LITTLE BIT, IF YOU MAY RECALL, LAST YEAR, LAST MAY, MAY 2024, THERE WAS A LETTER RECEIVED FROM THE SOMERSET GREATER SOMERSET COUNTY YMCA INDICATING SOME INTEREST IN HAVING A Y HERE IN MONTGOMERY. AND SO A COUPLE OF WEEKS AGO, ACTUALLY, ON OCTOBER 1ST, MYSELF, THE MAYOR, JOHN GROEGER, WHO'S OUR RECREATION DIRECTOR, HIS ASSISTANT DIRECTOR, AND LORI SAVRAN WENT FOR A VISIT TO THE SOMERSET HILLS Y IN BASKING RIDGE. AND WE WALKED AROUND AND WE SAW THE FACILITIES THAT THEY HAVE, AND WE STARTED TO HAVE A CONVERSATION. AND IT'S THE BEGINNING OF A CONVERSATION. SO AT THIS POINT, AND I KNOW THAT THE COMPANY, THE COMMUNITY HAS BEEN VERY INTERESTED IN THIS, WE ARE GOING TO BE EXPLORING WITH THE STAFF THE DIFFERENT INFORMATION THAT WE NEED TO COLLECT TO CONSIDER WHETHER TO MOVE FORWARD WITH A Y IN MONTGOMERY. SO AGAIN, THAT SAID VETERANS MEMORIAL PARK AT 2 P.M. SUNDAY, NOVEMBER 9TH. SECOND THING IS JUST A QUICK UPDATE ON THE LANDMARKS COMMISSION. YOU KNOW, ONE OF THE TOPICS THAT HAVE BEEN HAS BEEN COMING UP IS THE BLAWENBURG CEMETERY. I THINK, YOU KNOW, AS I'VE BEEN LEARNING, A LOT OF THESE OLDER CEMETERIES ARE RUN BY NONPROFIT ORGANIZATIONS. AND AS YOU CAN IMAGINE, YOU KNOW, SOME OF THESE HISTORICAL CEMETERIES HAVE HAVE RISING COSTS. AND IN THE CASE OF THE BLOMBERG CEMETERY, THERE'S A LOT OF OLD FENCES THAT, YOU KNOW, HAVE BEEN DAMAGED FOR MANY DIFFERENT REASONS. AND ONE OF THE THINGS THAT WE'RE REVIEWING IS, YOU KNOW, WHETHER OR NOT, YOU KNOW, THOSE FENCES CAN BE REMOVED OR REPLACED. AND THE REASON I BRING THIS UP IS, YOU KNOW, AND I'M SAYING THIS KIND OF ENDORSEMENT, BUT THAT'S A NONPROFIT ORGANIZATION THAT IS LOOKING TO TRY TO COMPLY WITHIN THE REQUIREMENTS OF THE LANDMARKS COMMISSION, TO MAINTAIN WITH THE HISTORICAL PERSPECTIVE. AND I DO WANT TO PROVIDE AN UPDATE FOR THE TOWNSHIP IS THAT, YOU KNOW, THE PARTIES HAVE COME TO AN AGREEMENT IN PRINCIPLE, AND THAT AGREEMENT HAS BEEN REDUCED TO A MEMORANDUM OF UNDERSTANDING, WHILE THE TERMS OF WHICH HAVE BEEN AGREED TO, YOU KNOW, WE ARE AWAITING FOR EXECUTION OF THAT MEMORANDUM OF AGREEMENT BY THE PBA, AT WHICH TIME THE FULL EXPECTATION IS THAT OUR TOWNSHIP COMMITTEE WOULD COUNTERSIGN IT. IT WOULD THEN MOVE TO RATIFICATION BY THE PBA, WHICH WE ARE OPTIMISTIC THAT THIS MATTER IS LARGELY CONCLUDED, EXCEPT FOR THE NEED FOR A RESOLUTION TO APPROVE THE RATIFICATION. THANK YOU. A LOT OF OTHER STATES DON'T HAVE RELIEF IN THE ON THE NEIGHBORHOOD OF 4 OR 5, $6,000, DEPENDING ON, OF COURSE, A NUMBER OF THINGS. AND THE INCOME REQUIREMENTS ARE PRETTY HIGH. LIKE FOR ANCHOR, THERE'S ONE CATEGORY WHERE YOU JUST HAVE TO HAVE MAKE LESS THAN $250,000 IN INCOME. AND THEN THERE'S ANOTHER CATEGORY. IT SAYS 150,000 INCOME. SO THESE ARE THESE ARE NOT LIKE REALLY LOW INCOME REQUIREMENTS. SO A LOT OF PEOPLE ACTUALLY QUALIFY. BUT WHEN YOU COULD BE ELIGIBLE FOR THOUSANDS OF DOLLARS OF RELIEF. SO OCTOBER 31ST IS THE DEADLINE FOR APPLYING FOR THESE STATE PROGRAMS, AND WE DECIDED TO HAVE AN EVENT HERE WHERE THERE'LL BE INDIVIDUALS TO HELP FILL OUT THE FORMS. SO YOU CAN LITERALLY JUST COME IN AND GET, YOU KNOW, HAVE, YOU KNOW, HAVE YOUR HAND HELD WHILE YOU WHILE YOU FILL OUT THE FORM TO SEE IF YOU'RE ELIGIBLE, THE TIME FRAME FOR THAT, THE FOR 4 TO 7, 4 TO 7 ON MONDAY OCTOBER 20TH. THE MOST FAVORITE PART ABOUT MY JOB IS FARMLAND ASSESSMENT. THE NEW JERSEY FARMLAND ASSESSMENT ASSESSMENT ACT OF 1964 PERMITS FARMLAND AND WOODLAND ACRES TO BE ASSESSED AT THEIR PRODUCTIVITY VALUE. THESE VALUES ARE REGULATED ANNUALLY BY THE NEW JERSEY DEPARTMENT OF AGRICULTURE. THE MINIMUM REQUIREMENTS. YOU MUST OWN YOURT OF FIVE CONTIGUOUS ACRES. GROSS SALES MUST AVERAGE $1,000 FOR FARMLAND ASSESSMENT AND $500 FOR WOODLAND MANAGEMENT. THE OWNER MUST FILE THEIR APPLICATION ANNUALLY BY AUGUST 1ST. MOST APPLICANTS COME IN PERSONALLY TO ME TO DROP OFF THEIR FARMLAND APPLICATIONS.

WHAT IS FARMLAND? PRESERVATION. IT IS AN IMPORTANT PART OF KEEPING NEW JERSEY GREEN AND PROSPEROUS. FARMS ARE DEVELOPMENT.

SO NO INCREASE IN TOTAL UNITS SINCE THE PROJECT HAD BEEN APPROVED.

BUT THROUGH THIS PROJECT, THE PILOT PROJECT, WE WERE ABLE TO GET AN ADDITIONAL. RECALCULATED, JUST KIND OF GOING BACK INTO HISTORY, IF YOU REMEMBER THIS, THIS PROJECT BACK IN 2016, THIS IS WHAT IT LOOKED LIKE, THE FIRST PHASE OF VILLAGE. BACK THEN IT WAS CALLED VILLAGE SHOPPER. IT WAS VILLAGE SHOPPER ONE, TWO AND THREE. THE FIRST PHASE WAS CONSTRUCTED IN 1978.

THE SECOND WAS IN 1982 WHEN THE CURRENT OWNER ACQUIRED IT IN 2016, VILLAGE SHOPPER ONE HAD AN 80% VACANCY RATE AND THERE WAS AN ENVIRONMENTAL CONTAMINATION ISSUE. THERE WAS AN OIL TANK LEAK THAT THAT HAS SINCE OBVIOUSLY BEEN CLEANED UP AND AND EVERYTHING'S BEEN APPROVED BY DEP. VILLAGE SHOPPER TWO WAS 40% VACANT UPON PURCHASE. AND THEN I THINK IF YOU RECALL, SOME OF THOSE TENANTS MOVED ACROSS THE STREET TO MONTGOMERY SHOPPING CENTER.

SO IT IT LATER BECAME 80% VACANT WITHIN A YEAR. SO IN 2018 THERE WAS AN OVERLAY ZONE.

AND THEN IN 2025 WE DID THE REDEVELOPMENT PLAN. AND THEY WERE REALLY TO EFFECTUATE SEVERAL TOWNSHIP POLICY INITIATIVES THAT WERE SET FORTH BACK PRIOR TO 2018, PROVIDE ROUND THREE AFFORDABLE HOUSING ALONG THE PUBLIC TRANSIT LINE. AND SO YOU CAN SEE THIS 2016 AERIAL OF THE PROPERTY, WHERE IN THE BACK THERE WAS AN OLD SEPTIC SYSTEM, IT WAS REMOVED AND THE SITE WAS CONNECTED TO SEWER. SO THAT LAND BECAME AVAILABLE. AND SO THE OLD ONE STORY RETAIL HAS SINCE COME DOWN. AND WHAT YOU'RE SEEING, WHAT YOU WILL SEE AS PART OF THIS PROJECT IS THAT THREE STORY. IT'S THREE STORY IN THE FRONT, BUT IT BECAUSE OF THE GRADE OF THE PROPERTY AND HOW IT RISES AT THE REAR, IT ENTERS AT THE SECOND FLOOR AT THE BACK.

AND THERE'S A FEW DIFFERENT METRICS THAT WE LOOK AT WHEN DETERMINING FEASIBILITY. ONE IS THE INTERNAL RATE OF RETURN, WHICH IS A METRIC THAT CONSIDERS THE AMOUNT OF EQUITY A DEVELOPER PUTS IN. AND IF THEY SELL IT AFTER TEN YEARS, WHAT IS THAT AVERAGE RATE OF RETURN OVER THAT TEN YEAR PERIOD? TYPICAL MARKET RETURN IS SOMEWHERE BETWEEN 10 AND 15% FOR IRR. HERE. YOU SEE UNDER CONVENTIONAL TAXES IT'S A NEGATIVE NUMBER. SO FIRST RED FLAG THAT THIS MAY NEED SOME ASSISTANCE OF SOME KIND. NEXT IS YIELD ON COST. THAT IS THE NET OPERATING INCOME OF THE PROJECT DIVIDED BY THE TOTAL PROJECT COST. AGAIN THERE ARE STANDARDS IN THE MARKET. DEVELOPERS ARE TYPICALLY TARGETING A YIELD ON COST

SOMEWHERE IN THE FIVE AND A HALF TO SIX AND A HALF, MAYBE EVEN 7%. AND HERE YOU HAVE A YIELD ON COST BELOW THREE. LASTLY, AND PROBABLY MOST IMPORTANTLY, IN TERMS OF ACTUALLY GETTING THE FINANCING FOR A PROJECT, IS THE DEBT SERVICE COVERAGE RATIO. THAT IS A KEY METRIC THAT TRADITIONAL LENDERS AND BANKS USE TO DETERMINE IF A PROJECT IS GOING TO HAVE THE ABILITY TO PAY BACK THE LOAN, IT DETERMINES THE AMOUNT OF MONEY THEY'RE GOING TO LOAN TO A PROJECT. IN TODAY'S MARKET, A LENDER IS LOOKING FOR A MINIMUM OF 1.2 COVERAGE, MEANING THAT THE PROJECT HAS TO GENERATE 120% OF THE ANNUAL DEBT SERVICE AMOUNT.

SO IN THIS CASE, THAT 1.03 NUMBER BASICALLY MEANS THAT AFTER, YOU KNOW, CONSIDERING THE RENTS AND THE EXPENSES, THEY'RE GOING TO HAVE BASICALLY JUST ENOUGH MONEY TO PAY BACK THE LOAN. THERE WILL BE ALMOST NOTHING LEFT IN CASH FLOW, CASH FLOW FOR THE PROJECT, AT LEAST INITIALLY. SO BASED ON ALL OF THOSE FACTORS, IT'S CLEAR TO US THAT IT'S HIGHLY UNLIKELY THAT THIS PROJECT WOULD MOVE FORWARD, THAT IT WOULD GET THE FINANCING IT NEEDS UNDER CONVENTIONAL TAXES. SO THEN IF YOU LOOK TO THE RIGHT, YOU HAVE THE SAME NUMBERS, SAME RENT ASSUMPTIONS, SAME OPERATING EXPENSES ASSUMPTIONS, SAME PROJECT COST ASSUMPTION. THE ONLY DIFFERENCE IS THAT PROPERTY TAX LINE ITEM IS NOW THE PILOT PLUS ADMIN FEE LINE ITEM. AND YOU'LL SEE IT'S ABOUT 50% OF WHAT CONVENTIONAL TAXES WOULD BE. NOW I WILL SAY THAT PHASE ONE IS EXTREMELY TIGHT ECONOMICALLY. I DON'T FEEL LIKE THIS PROJECT, PHASE ONE ON ITS OWN WOULD GET BUILT.

IT'S BASICALLY A PACKAGE DEAL WHERE PHASE ONE IS THE ANCHOR THAT WILL GENERATE FOOT TRAFFIC AND ASSIST WITH THE LEASE UP OF THE RESIDENTIAL COMPONENT AND THE LARGER RETAIL COMPONENT OF PHASE TWO. SO HERE YOU DO GET TO A DEBT SERVICE COVERAGE RATIO OF 1.2. I WILL SAY THE DEVELOPER IS GOING TO HAVE TO PROVIDE A SIGNIFICANT AMOUNT OF EQUITY TO GET TO THAT 1.2 COVERAGE RATIO, AND YOU'RE STILL AT YIELDS THAT ARE MUCH LOWER THAN THE MARKET. SO FOR THIS PROJECT, IF WE GO TO THE NEXT SLIDE. ACTUALLY. SO YEAH WE'LL GO INTO PHASE TWO. AND THEN I'LL GO INTO THE ECONOMICS OF THE OF PHASE ONE AND PHASE TWO. SO PHASE TWO THIS IS THE UNIT MIX. THERE'S A CAVEAT HOWEVER AS THE TEAM MENTIONED EARLIER THERE ARE 12 AFFORDABLE UNITS IN THE PROJECT. I APOLOGIZE. THIS SPREADSHEET SHOWS 11 AFFORDABLE UNITS. BUT NOW THERE WILL BE 40 MARKET RATE UNITS AND 12 AFFORDABLE UNITS. ONE OF THE ADJUSTMENTS THAT WE DID MAKE ON THE REVENUE SIDE FOR PHASE TWO WAS WE INCREASED THE DEVELOPERS RENTS PRETTY DRAMATICALLY. WE TOOK A LOOK AT SOME OF THE COMPS, ESPECIALLY, I BELIEVE IT'S RIGHT ACROSS THE STREET, THE SOMERSET AT MONTGOMERY, WHICH WAS BUILT, I BELIEVE, LAST YEAR. AND SO WE TOOK A LOOK AT WHAT THE CURRENT AVAILABILITIES ARE AT THAT BUILDING, AND WE INCREASED THE DEVELOPERS PROJECTIONS BY, I BELIEVE, 25%. SO. WHAT YOU'RE SEEING HERE ARE MORE APPROPRIATE RENT ASSUMPTIONS, I BELIEVE, WHICH PLAYS A ROLE IN THE DEVELOPERS RETURNS. AND IT ALSO PLAYS A ROLE IN THE PROJECTED PILOT REVENUE, BECAUSE OBVIOUSLY THE PILOT REVENUE IS BASED ON A PERCENTAGE OF ACTUAL REVENUE.

SO IF RENTS ARE HIGHER THAN THIS, THE PILOT WILL BE HIGHER THAN THIS. IF RENTS ARE LOWER THAN THIS, THE PILOT WILL BE LOWER THAN THIS. AND YOU'LL SEE, YOU KNOW, THERE ARE MULTIPLE FACTORS THAT AFFECT FEASIBILITY, ESPECIALLY FOR A RESIDENTIAL PROJECT. ONE IS MARKET RATE VERSUS AFFORDABLE. YOU KNOW, THIS PROJECT WOULD LOOK A LOT DIFFERENT IF IT WAS 100% MARKET RATE. THE RETURNS WOULD BE HIGHER. ANOTHER IS STRUCTURED PARKING VERSUS SURFACE PARKING.

THIS ALLOWS FOR SURFACE PARKING, WHICH IS, YOU KNOW, CHEAPER TO BUILD THAN STRUCTURED PARKING.

STRUCTURED PARKING COSTS 25 30,000 PER SPACE. SURFACE PARKING COSTS 5000 7500 PER SPACE. SO IN THIS CASE YOU DON'T HAVE THE ISSUE WITH STRUCTURED PARKING. THE OTHER PIECE IS SITE WORK, YOU KNOW, AND THE TOWNSHIP INFRASTRUCTURE. THAT'S SOMETHING THAT'S UNIQUE ABOUT THIS PROJECT, AS WELL AS THE ELEVATION CHANGES THAT MAKE IT A LITTLE BIT MORE DIFFICULT TO BUILD, MORE EXPENSIVE TO BUILD. BASED ON THE ESTIMATES BETWEEN TRAFFIC LIGHT IMPROVEMENTS, BYPASS ROADS, PUMPING STATION UPGRADES, RETAINING WALLS, AND THE INCREASED COST OF THE BUILDING. BECAUSE OF THE ELEVATION, THERE'S ABOUT $4 MILLION OF ADDITIONAL COSTS. THAT WOULDN'T BE THE CASE IN A DIFFERENT LOCATION. SO BETWEEN THE 20% AFFORDABILITY, THE ADDITIONAL $4 MILLION IN EXTRAORDINARY COSTS, THAT IS WHAT'S PUTTING A

LOT OF PRESSURE ON THE ECONOMICS OF THE OF THE PROJECT. FOR PHASE TWO, IF WE GO TO THE NEXT SLIDE. SO AGAIN, SAME ANALYSIS AS YOU SAW FOR PHASE ONE UNDER CONVENTIONAL TAXES AND FOR THE CONVENTIONAL TAX ESTIMATE FOR PHASE TWO AND FOR PHASE ONE. SO PHASE TWO, THE RESIDENTIAL PROJECT THAT WE USED AS THE COMP SOMERSET AT MONTGOMERY JUST GOT PUT ON THE BOOKS. SO WE KNOW WHAT THEY ARE PAYING IN CONVENTIONAL TAXES, AND THEY'RE AT ABOUT 4500, 4600 PER UNIT. THAT'S THEIR TAX AMOUNT. SO WE USE THE SAME ASSUMPTION FOR THIS PROJECT.

JUST TO GIVE YOU A SENSE THAT WE FEEL CONFIDENT THAT THAT IS IN LINE WITH HOW IT WOULD BE ASSESSED. AND THEN FOR THE RETAIL COMPONENT, THERE'S ALSO THE VILLAGE SHOPS. THAT IS A I THINK IT'S JUST UNDER 10,000 SQUARE FOOT EXISTING RETAIL BUILDING THAT WAS RECENTLY BUILT. THAT ONE'S PAYING ABOUT $7 PER SQUARE FOOT. SO WE USE THAT ASSUMPTION FOR THE RETAIL COMPONENT. SO AGAIN, UNDER CONVENTIONAL TAXES THE RETURNS ARE LOW IN TERMS OF INTERNAL RATE OF RETURN YIELD ON COST DEBT SERVICE COVERAGE RATIO. AGAIN WE BELIEVE IT'S UNLIKELY THAT THIS PROJECT WOULD BE FINANCED AND BUILT UNDER CONVENTIONAL TAXES. WE THEN MOVED TO THE PILOT SCENARIO. AGAIN. THESE ECONOMICS ARE TIGHT. YOU KNOW, I LOOK AT PROJECTS EVERY SINGLE DAY, AND THESE ARE ON THE LOW END OF THE RETURNS THAT I SEE FOR FOR PROJECTS LIKE THIS. SO IT WILL REQUIRE THE DEVELOPER TO PUT IN SOMEWHERE AROUND 40% EQUITY. SO YOU HAVE A PROJECT COST OF ESTIMATED TO BE $30 MILLION. THEY'RE GOING TO BE PUTTING UP $12 MILLION OF THEIR OWN MONEY. THE REST WILL COME FROM TRADITIONAL LENDERS. IF YOU GO TO THE NEXT SLIDE, PLEASE. OKAY. A LOT OF NUMBERS ON HERE, BUT THIS IS A BREAKDOWN BOTH BY YEAR AND OVER THE 30 YEAR PERIOD OF THE PHASE ONE PILOT PROJECTIONS. SO THE PHASE ONE PILOT IS BASED ON 10% OF AGR ANNUAL GROSS REVENUE FOR A 30 YEAR PERIOD. AS YOU SAW THE ECONOMICS, EVEN UNDER THE 10% PILOT ARE EXTREMELY TIGHT. SO WHAT YOU'RE SEEING DOWN THE LINE, ALSO, I'LL JUST ADD IN THE PERCENTAGE OF, OH, THAT IS PART OF THE STATUTE, THE LONG TERM TAX EXEMPTION LAW, IN ADDITION TO A PERCENTAGE OF GROSS REVENUE, THERE IS A MANDATORY GRADUAL PHASE IN OF CONVENTIONAL TAXES. SO THERE ARE DIFFERENT MINIMUM AND MAXIMUM STAGE LENGTHS, BUT THEY START AT 0% OF CONVENTIONAL TAXES 20%, 40%, 60% AND 80%. SO EVERY YEAR THE CALCULATION IS BASED ON THE GREATER OF THAT PERCENTAGE OF GROSS REVENUE OR THAT PERCENTAGE OF OTHERWISE APPLICABLE TAXES. SO OBVIOUSLY, FOR THE FIRST 15 YEARS, THE CALCULATION IS STRICTLY BASED ON 10% OF ANNUAL GROSS REVENUE, BECAUSE YOU'RE IN THAT FIRST STAGE OF THE PHASING OF CONVENTIONAL TAXES AT ZERO. THEN STARTING IN YEAR 16, YOU HAVE TO DO THE COMPARISON BETWEEN 10% AND 20% OF CONVENTIONAL TAXES. SO TYPICALLY THAT TRANSITION HAPPENS AT THE 60% STAGE, WHERE 60% OF CONVENTIONAL TAXES MAY VERY WELL BE GREATER THAN 10% OF GROSS REVENUE. IT'S FAR OUT THERE. IT'S IN THE LATER YEARS, NO ONE KNOWS WHAT'S GOING TO HAPPEN WITH RENTS. BUT IN ADDITION, TO MAKE YOU FEEL CONFIDENT THAT THE DEVELOPER WILL BE PAYING THE CORRECT AMOUNT, THE APPROPRIATE AMOUNT BASED ON THE TERMS OF THE FINANCIAL AGREEMENT, THE FINANCIAL AGREEMENT DOES REQUIRE THAT ANNUALLY, THE DEVELOPER WILL SUBMIT A CERTIFIED AUDIT FROM A CPA FIRM THAT IDENTIFIES THE REVENUES AND EXPENSES, DOES A PILOT CALCULATION WITHIN THE AUDIT.

IT DOES A NET PROFIT CALCULATION, WHICH IS REQUIRED BY THE STATUTE. SO EVERY YEAR.

SO THE BILLS ARE SENT BASED ON ESTIMATES OF REVENUE. AND THEN WITHIN 90 DAYS OF THE END OF THE CALENDAR OR FISCAL YEAR, THEY HAVE TO PROVIDE THEIR AUDIT. THEN THERE'S A TRUE UP PROCESS, ESPECIALLY IN THE LEASE UP PHASE. IT'S REALLY KIND OF A GUESS AS TO HOW QUICKLY IT'S GOING TO LEASE UP. SO YOUR PILOT BILL MAY BE UNDERBUILT OR OVERBUILT. SO THERE WILL BE A TRUE UP PROCESS. BUT ONCE THE BUILDINGS ARE STABILIZED AND LEASED UP, THE YEAR TO YEAR REVENUE WILL TYPICALLY STAY THE SAME. SO YOU HAVE A GENERAL IDEA OF WHAT THE PILOT REVENUE WILL BE GOING FORWARD JUST TO, YOU KNOW, GO DOWN THE LINE WITH WITHOUT GETTING TOO INTO THE DETAILS, THEY WILL STILL BE REQUIRED TO PAY LAND TAXES, AND THEY RECEIVE A LAND TAX CREDIT AGAINST THE PILOT. SO, FOR EXAMPLE, THEIR GROSS PILOT IN YEAR ONE IS ESTIMATED TO BE 25,000 AND CHANGE. THEY WILL STILL PAY LAND TAXES OF ABOUT 6300, AND THEY'LL GET A CREDIT AGAINST THAT 25,000. SO IN TOTAL THEY'RE PAYING 25,000.

BUT A PORTION OF THAT IS FOR LAND. A PORTION OF THAT IS FOR PILOT. THE WAY THAT THE SPLIT

WORKS IS THE LAND TAXES WILL STILL BE SPLIT, JUST LIKE CONVENTIONAL TAXES, WHICH I BELIEVE IS ROUGHLY 70% TO THE SCHOOL, 15 AND 15 FOR THE COUNTY AND THE MUNICIPALITY.

WHEREAS UNDER THE PILOT, THE NET PILOT, AFTER THAT LAND TAX CREDIT IS APPLIED, 95% GOES TO THE TOWNSHIP, 5% GOES TO THE COUNTY. YOU THEN ALSO HAVE THE 2% ADMIN FEE, WHICH 100% GOES TO THE TOWNSHIP. SO AS EXPLAINED EARLIER, OVER THE 30 YEAR PERIOD, THE GROSS PILOT IS ESTIMATED TO BE ABOUT $1.1 MILLION FOR PHASE ONE, AND THE TOWNSHIP SHARE IS ABOUT $900,000. IF YOU COMPARE IT TO CONVENTIONAL TAXES, WHICH I ALWAYS, YOU KNOW, I DON'T LOVE THE COMPARISON. IT'S REALLY FOR ILLUSTRATION PURPOSES ONLY, BECAUSE THE WHOLE IDEA OF THE PILOT IS THAT IF IT WASN'T FOR THE PILOT, THE PROJECT WOULD NOT GET BUILT. SO IT IS A HYPOTHETICAL TO SEE A WHAT IF IF IT COULD BE BUILT UNDER CONVENTIONAL TAXES, WHAT WOULD IT PAY AND WHAT WOULD THE TOWNSHIP SHARE BE? SO WE HAVE THAT AS A COMPARISON. BUT AGAIN, THE WHOLE BASIS IS THAT THIS PROJECT WOULDN'T EXIST WITHOUT THE PILOT. SO UNDER CONVENTIONAL TAXES THEY WOULD PAY $2.6 MILLION. BUT BECAUSE THE MUNICIPALITY'S SHARE WOULD ONLY BE ABOUT 15%, THE TOWNSHIP SHARE WOULD BE ABOUT $400,000 OVER THAT SAME TIME PERIOD, COMPARED TO THE 900,000 UNDER THE PILOT. NEXT SLIDE PLEASE. SO THIS IS PHASE TWO. SAME EXACT BREAKOUT. HOWEVER, THE PILOT NEGOTIATION WAS FOR A MORE AGGRESSIVE PILOT FOR THE RESIDENT. THE MIXED USE PROJECT INSTEAD OF 10% FOR 30 YEARS, YOU HAVE 11% FOR THE FIRST 15 YEARS. AND THEN THAT BUMPS UP TO 12% FOR THE FINAL 15 YEARS. YOU'LL NOTICE IN YEAR ONE, THE GROSS PILOT IS SIGNIFICANTLY LOWER THAN ALL FUTURE YEARS. AGAIN, BECAUSE THE PILOT IS BASED ON A PERCENTAGE OF ACTUAL REVENUE RECEIVED, THERE WILL BE A LEASE UP PERIOD WHERE THEY'RE ACTUALLY RENTING OUT THE UNITS, RENTING OUT THE TENT, THE RETAIL SPACES. SO THE EARLIER YEARS MAY BE PRODUCE LOWER PILOT REVENUE BECAUSE THE ACTUAL REVENUE OF THE PROJECT IS LOWER. SO WE'RE ASSUMING THAT THERE'S GOING TO BE A LEASE UP PERIOD. AND THEN IN YEAR TWO IS OUR STABILIZED YEAR, WHICH WE ASSUME 95% OCCUPANCY. SO BASED ON OUR ADJUSTMENTS TO THE RENTS AND WHEN THE BUILDING IS 95% OCCUPIED, WE'RE ESTIMATING THAT THE GROSS PILOT WILL BE ABOUT $230,000 A YEAR, OF WHICH A SMALL PORTION WILL BE FOR A LAND TAX CREDIT, AND THE TOWNSHIP SHARE WILL BE A LITTLE OVER $200,000 A YEAR. THAT BUMPS UP. IF YOU LOOK AT YEAR 16, WE'RE ASSUMING AN ANNUAL RENT INCREASE OF 2% A YEAR. RECENTLY, IT'S BEEN MUCH MORE THAN THAT. BUT OVER THE 30 YEAR PERIOD, WE'RE WE'RE HOPING I WOULD THINK WE'D HOPE IT STABILIZES AND DOESN'T KEEP GOING UP AT FIVE, 6% A YEAR. BUT IN YEAR 16, BASED ON THAT 2% PER YEAR REVENUE INCREASE, THE PILOTS ESTIMATED TO BUMP UP TO ABOUT $376,000, OF WHICH THE TOWNSHIP SHARE WOULD BE ABOUT 345. SO OVER THE 30 YEAR PERIOD, TOWNSHIP SHARE OF PILOT REVENUES HAS TO BE ESTIMATED TO BE ABOUT 10.1 MILLION. TOWNSHIP SHARE WOULD BE ABOUT 38,000. AS COMPARED TO THE NUMBERS THAT I JUST SPOKE ABOUT 900,000 FOR THE TOWNSHIP OVER THE 30 YEAR PERIOD. NEXT SLIDE PLEASE. SAME COMPARISON. THE PHASE TWO SITE, AS IT'S A LITTLE BIT LARGER, GENERATES SLIGHTLY MORE TAX REVENUE. CURRENTLY ABOUT 18,000 $19,000, OF WHICH THE TOWNSHIP SHARE IS ABOUT $2,800 OVER THE 30 YEAR PERIOD. WITHOUT THE REDEVELOPMENT, IT WOULD GENERATE ABOUT $113,000 FOR THE TOWNSHIP, AS COMPARED TO ABOUT $10.1 MILLION OVER THAT 30 YEAR PERIOD. SO A SIGNIFICANT BOOST IN REVENUE AS COMPARED TO WHAT THE SITES ARE CURRENTLY GENERATING. WE ALSO, AS PART OF OUR ANALYSIS, PREPARED A FISCAL IMPACT, WHICH ONE IDENTIFIES THE PROJECTED NUMBER OF RESIDENTS AND THE PROJECTED NUMBER OF SCHOOL CHILDREN THAT WILL BE GENERATED BY THIS PROJECT, AND THEN ASSIGNS THE ASSOCIATED COSTS TO THOSE NEW

RESIDENTS AND SCHOOL CHILDREN. THERE IS A STUDY THAT WAS DONE CALLED THE WHO LIVES IN NEW JERSEY HOUSING STUDY BY THE BLOUSTEIN SCHOOL AT RUTGERS. IT'S PRETTY MUCH CONSIDERED THE GOLD STANDARD IN THE INDUSTRY FOR PROJECTING RESIDENT AND SCHOOL CHILDREN IMPACT FOR NEW DEVELOPMENT IN NEW JERSEY. THAT STUDY WAS DONE ORIGINALLY IN THE LATE 2000. IT WAS UPDATED, I BELIEVE, IN 2018, TO INCORPORATE NEW CONSTRUCTION, NEW CONSTRUCTION, MORE EFFICIENT BUILDINGS, A LOT OF SMALLER UNIT SIZES, A LOT MORE STUDIOS, ONE BEDROOMS AND LESS OF THE LARGE 234 BEDROOM UNITS. AND THEY RESEARCHED TENS OF THOUSANDS OF UNITS ACROSS THE STATE AND LOOKED AT THE ACTUAL RESIDENTS COMING OUT OF THOSE UNITS AND THE ACTUAL PUBLIC SCHOOL CHILDREN COMING OUT OF THOSE UNITS TO BE ABLE TO APPLY MULTIPLIERS TO DIFFERENT PRODUCT TYPES. THE COUNTY ENGINEER AND THEIR CONSULTANTS RAN THROUGH A WIDE RANGE OF ALTERNATIVES OF HOW WE COULD, HOW THEY AS A COUNTY BRIDGE, HOW THE COUNTY COULD ADDRESS THE ONE LANE BRIDGE OVER THE MILLSTONE RIVER THAT CONNECTS MONTGOMERY INTO FRANKLIN. THEY OPTED TO GO WITH PREFERRED ALIGNMENT TO A, WHICH INVOLVES A TRAFFIC LIGHT AT THE INTERSECTION OF THE BRIDGE AND RIVER ROAD ON THE MONTGOMERY SIDE, AND A CORRESPONDING TRAFFIC LIGHT ON CANAL AND THE GRIGGSTOWN CAUSEWAY, AND WE WERE SET TO ENDORSE IT.

FRANKLIN TOWNSHIP TOOK A LITTLE TIME. THEY THEY WERE WRESTLING WITH THE TRAFFIC LIGHT AND THE GRIGGSTOWN INTERSECTION, BUT THEY HAVE COME ON BOARD AND DONE THE RESOLUTION. SO THE COUNTY HAS ASKED US TO NOW GO AHEAD AND PASS OUR RESOLUTION OF SUPPORT. AND I JUST WANT TO NOTE, WE DID ADD INTO OUR RESOLUTION AND HAVE MADE NOTE AND WILL CONTINUE TO ADVOCATE TO SOMERSET COUNTY THAT THE INTERSECTION OF BELLE MEAD, GRIGGSTOWN ROAD AND RIVER ROAD, WHICH IS IN CLOSE PROXIMITY TO THE GRIGGSTOWN CAUSEWAY AND BRIDGE, THAT THE THAT THEY NEED TO INVESTIGATE AND KIND OF DEAL WITH THE TRAFFIC AND ACCIDENTS THAT MANY ACCIDENTS THAT WE HAVE AT THAT INTERSECTION AS WELL KNOW THAT THAT IS GOOD. MY I THINK MY ONLY ASK WHEN WE DISCUSS THIS LORRY WAS THAT THERE HAVE BEEN SOME RESIDENTS WHO HAVE BEEN CONCERNED ABOUT WHERE THIS TRAFFIC LIGHT WOULD BE BECAUSE THERE ARE HOMES VERY CLOSE ON MONTGOMERY SIDE, CLOSE TO THAT.
